TERMS OF SERVICE

1. Acceptance of Terms

Bizzy Deals LLC (“Bizzy,” “we,” “us,” or “our”) owns and operates the website www.bizzyu.com, the Bizzy mobile application, and any other sites or services we create in the future that reference these Terms of Service (collectively, the “Site”).

By:

  • Using Bizzy’s services
  • Signing up for an account
  • Redeeming a deal
  • Entering your email or accepting notifications

You agree to these Terms of Service and our Privacy Policy, incorporated by reference.

If you do not agree, discontinue use immediately.

2. About the Site

Bizzy provides a platform where participating merchants (“Merchants”) offer:

  • Vouchers for products, services, or experiences
  • Special offers directly to users (“Merchant Deals”)

Bizzy is not responsible for the quality, pricing, or availability of any Merchant Deals. Merchants control and manage their own deals.

3. No Guarantee of Merchant Compliance

Bizzy does not control or guarantee that a merchant will honor a listed deal. If a merchant:

  • Refuses to honor a deal
  • Modifies pricing
  • Changes availability

     

Users must resolve the issue directly with the merchant. Bizzy is not liable for merchant decisions.

4. No Endorsement of Merchants

Bizzy does not endorse, verify, or guarantee the quality, safety, legality, or reliability of any merchant, product, or service. Any issues must be resolved directly between the user and the merchant.

5. No Responsibility for User Conduct

Users are solely responsible for their actions on Bizzy.

  • Fraudulent activity may result in account termination without refund.
  • Users must comply with all laws when redeeming deals.
  • Bizzy is not responsible for misuse of deals.

6. Ownership of the Site

Bizzy and its licensors own all rights to the app, website, content, trademarks, and underlying code.

Users may not:

  • Copy, modify, or distribute any part of Bizzy
  • Reverse-engineer or extract code
  • Use automated tools (e.g., bots, crawlers) to access Bizzy

     

Unauthorized use may result in account termination and legal action.

7. Limitation of Warranties & Services Provided “As-Is” TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • BIZZY PROVIDES ITS SERVICES “AS IS” AND “AS AVAILABLE.”

     

  • NO GUARANTEES of uninterrupted service, error-free functionality, or accuracy of deals.

     

  • BIZZY IS NOT LIABLE for downtime, service errors, or lost data.

8. No Liability for Third-Party Services

Bizzy integrates with third-party services (e.g., Apple Pay, Stripe, Google Maps).

  • Bizzy does not control or guarantee third-party functionality.
  • Users must resolve disputes with the third-party service provider.

9. Payment Processing Disclaimer

  • Payments are handled by third-party processors (e.g., Stripe, Apple Pay).
  • Bizzy does not store or process payment details.
  • Bizzy is not liable for fraudulent transactions, chargebacks, or billing disputes.

10. No Guarantee of Service Availability

  • Bizzy reserves the right to modify, suspend, or discontinue any feature at any time.
  • We do not guarantee the continued availability of any deal or service.

11. Savings Disclaimer

  • Displayed discounts and savings are estimates.
  • Actual savings may vary due to taxes, fees, tipping policies, regional pricing differences, or merchant discretion.
  • Bizzy is not responsible if actual savings differ from those displayed.

Users should confirm deal details with merchants before redemption.

12. Refund & Chargeback Policy

  • All purchases and redemptions are final.
  • Bizzy does not issue refunds for redeemed deals.
  • Users must resolve pricing disputes directly with merchants.
  • Chargebacks may result in account suspension.

13. Right to Modify or Remove Deals

Bizzy reserves the right to:

  • Modify, suspend, or remove any deal at any time
  • Restrict availability based on user location or eligibility

     

Bizzy does not guarantee the availability of any specific deal.

14. User Responsibility for Account Security

  • Users are responsible for securing their accounts and keeping login credentials private.
  • Bizzy is not liable for unauthorized access due to user negligence.

15. 21+ Deals & Underage Use

  • Deals restricted to users 21+ will be labeled “(21+).”
  • Bizzy is not liable for underage users accessing age-restricted offers.
  • Users are responsible for compliance with applicable laws.

16. Force Majeure (Events Beyond Our Control)

Bizzy is not responsible for service failures due to:

  • Natural disasters
  • Cyberattacks
  • Government restrictions
  • Internet outages

     

We reserve the right to suspend operations during force majeure events.

18. Data Collection & Privacy Acknowledgment

By using Bizzy, users consent to the collection and processing of data as described in our Privacy Policy.

Bizzy is not responsible for unauthorized access or third-party data breaches.

19. No Obligation to Support or Maintain Features

Bizzy may modify, discontinue, or remove features at any time. We are not obligated to provide ongoing support for any feature.

20. Governing Law & Dispute Resolution

  • These Terms are governed by Florida law.
  • All disputes must be resolved through binding arbitration in Florida (AAA Rules).
  • No class actions—claims must be filed individually.

 

21. Entire Agreement & No Waiver

These Terms constitute the entire agreement between users and Bizzy.

  • No verbal or written agreements outside of these Terms shall apply.
  • No waiver of a provision shall be deemed a continuing waiver.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23. Changes to These Terms

Bizzy reserves the right to update these Terms at any time. Continued use of Bizzy after updates constitutes acceptance of the changes.
